Terms and Conditions

Welcome to Detourdrive. These Terms and Conditions ("Terms") govern your use of the Detourdrive service ("Service"), a mobile application and e-hailing payment platform offered by Detour Holdings t/a Detour Limited (Pty) Ltd, herein referred to as Detourdrive. with Registration Number: 2025/819492/07 and situated at 6 Carey Street, Wynberg, Sandton, Gauteng, 2090.

Use of the Detour wallet website and Wallet Mobile App is entirely at your own risk. This Website and Mobile App is made available to you by Detour conditional upon your acceptance, without modification of these Terms and Conditions as amended from time to time.

These Terms and Conditions, including our Privacy Policy and all other policies that may be posted on the Website set out the terms by which we provide you access to use our Website/App. Our relevant policies are incorporated into these Terms and Conditions. You agree to comply with all of our policies and in particular these Terms and Conditions when you access and use our Website or Mobile App. The terms website and Mobile App can be used interchangeably. It is your responsibility to familiarise yourself with these Terms and Conditions and check them regularly for any updates.

By accessing the Website or the Detourdrive mobile App you agree to all the terms set out in these Terms and Conditions. Should you not agree to these terms and conditions, or any of our updates or changes thereto as dealt with below, you should not access or use the Website or Mobile App.

By registering you confirm that you are 18 years of age or older and that you have been duly assisted to consent to these Terms and Conditions. You may not use the Website or Mobile App if you are less than 18 years of age. If you are younger than 18 years of age, your parents or another competent adult needs to consent to the Terms and Conditions. If you are younger than 18 years of age and your parents have not given their consent to these Terms and Conditions, you must not use or access our Website or Mobile App.

Detourdrive provides a digital wallet payment service powered by a software application and digital services platform. The service enables an e-hailing and or a logistics and an independent driver that is registered with Detourdrive to request a payment advance against their next salary. Should a payroll advance be granted to a driver by Detourdrive then driver payments are processed in partnership with Silicon Capital (Pty) Ltd, a Third-Party Payment Processor (TPPP) and digital wallet platform provider with Registration Number 2017/458763/07 who provides the receipt of funds designated for the payment of a payroll advance to the relevant e-hailing drivers as approved by Detourdrive.

All monies made as electronic deposits into the Detour Digital Wallet are to be utilised for salary advances to registered Detour e-hailing drivers, such funds being held in a designated non-interest bearing account at Nedbank. Nedbank Limited Reg No 1951/000009/06 is
a licensed financial services provider (FSP9363) and registered credit provider (NCRCP16), herein referred to as (“the bank”) where funds are held prior to disbursement to Detour e-hailing drivers. Any reference to “us” shall be deemed to mean Detour or Silicon Capital or the bank as the context indicates.

Neither Detour nor its TPPP, Silicon Capital, are taking deposits or using the funds that are destined as payments to e-hailing drivers for other purposes.

THIS AGREEMENT:

The legal terms outlined in this agreement are between you as the user of the Detourdrive App and Digital Wallet and Detourdrive, herein referred to as the payroll advance service.  By accepting these terms and conditions you agree to such terms and conditions by registering
on the Website or downloading the App from the appropriate Android or Apple store and registering on the App, completing the on-boarding process and utilising the cashless Taxi payment service. If you do not agree to the terms and conditions outlined in this agreement you will
not be able to completed the registration and on-boarding process to activate and utilise the Detourdrive wallet payment service.

ELIGIBILITY

Only persons aged 18 years and older and who are deemed competent to enter into a legally binding agreement

are allowed to register for this service. If you are a scholar and under the age of 18 years old your parent or legal guardian can register and operate the service to enable you to access the transport service. By accessing the Detourdrive service you are agreeing to be bound by the terms and conditions of this service. You may be required to create a “wallet” or “account” to use certain features of the service.

CONFIDENTIALITY

You agree not to disclose your confidential access credentials or secure PIN or voucher information to any third-party. You are responsible
to maintain the confidentiality of your log-in and account information.  Neither Detourdrive, nor its payment processor nor the “bank” shall be liable for losses incurred as a result of you, the user, disclosing your confidential account information or Access PIN or voucher PINs to a
third-party. As a user of the service it is your responsibility to maintain the confidentiality of your account information including your user name and password that you create when accessing the service and using the features of the service. You agree to notify us immediately if you are made aware of a security breach that deems your wallet or account to be compromised.  Such security breaches could include:

1. You lose your mobile phone.

2. You share your user name and password or PIN;

3. You share transaction information such as voucher code and PIN;

4. You share your wallet information with a third-party

5. You are aware that your identity has been compromised, i.e. identity theft.

6. You aware that a scammer has compromised your wallet account
   
   

THE USE OF THE SERVICE

The Service is for your personal use to enable you to receive payroll advance payments via the Detourdrive wallet which is available in the Detour App.

YOUR PERSONAL INFORMATION

Detour shall store and keep your personal information secure. We shall store only your personal information required to accurately identify
you as a user for the purposes or ID verification in order to comply with the requirements of the Financial Intelligence Centre Act (FICA) and Know Your Customer (KYC). Typically we shall store your first name, surname, ID Number or passport number or asylum seeker number,
your contact information including mobile number and IP Address and e-mail address, your geographic information using GPS functionality any facial recognition scanning and/or biometric scanning required for security or verification purposes, your transactional history and any other related financial information required to execute a transaction.

By accessing this service you agree that Detourdrive or its payment processing partner, Silicon Capital, are entitled to verify your personal details by checking your identity with the South African Department of Home Affairs or third-party data bureau for the purposes of verifying that the personal information provided to Detourdrive is valid and verifiable.  You also agree that when required Detourdrive or its processing partner, Silicon Capital, shall be entitled to check against Anti Money Laundering (AML) or Terrorist Financing (TF) databases.  In the event
that your personal information is flagged as you being a high risk individual we shall have the right to prevent you accessing the service and to terminate your access to the service.

We shall only keep your information that is required for us to render the service and we shall not share your information with any third party without your consent.  In the event that you notify us in writing to delete your personal information from the Detourdrive App we shall endeavour to do so within a reasonable time period provided the regulatory framework makes provision for such. 

You have the right to request the deletion of your personal information. However, due to legal, regulatory, and financial compliance obligations, certain data related to your transaction history cannot be deleted. This includes transaction records, payment details, and other relevant financial data. You can still request the deletion of non-essential data such as profile information, contact details, and any preferences that are not required for legal or financial purposes. If you would like to proceed with a data deletion request, please contact our support team.  You can do this via the Detour Drive app.

ANTI-MONEY LAUNDERING AND OTHER ACTIVITIES

You herein agree, acknowledge and understand that Detourdrive and its processing partner operates the wallet program under a bank sponsorship arrangement between the bank and the Third-Party-Payment-Processor (TPPP). You hereby agree to provide us with all information or documentation as may be requested in terms of anti-money laundering, anti-bribery and corruption and counter-terrorist financing legislation applicable to local and international legislation in order for us to render the Detourdrive payroll advance service.  If required you hereby consent that we may disclose your information to the bank, the regulator or any third-party who is legally entitled to receive your information in terms of FICA and Anti-Money Laundering (AML) or Terrorist Financing (TF).

By using the App you agree that we shall not be held liable for any loss that occurs or arises as a failure to comply with the policies and rules of the IOS App Store or Google Pay Store.

You shall not use the App and/or it functions and services to commit any of the following acts: 

1. Any act which undermines the bank, the TPPP, Detourdrive service providers and Detourdrive merchants;

2. Your use of a bank account which does not belong to you to receive your payroll advance in the event that you wish the Third-Party Payment Processor to process the salary advance into your personal bank account.

3. An act that Detourdrive, the TPPP or the bank or the banking and payments regulator, a merchant or EFT payment service provider believes to be illegal, abusive or unlawful behaviour in violation with bank rules, card program rules or payment network rules;

4. Any act by yourself as a user which is deemed to be in contravention with the rules of the online store where you downloaded your Detourdrive App. The App store rules will apply rather than these terms and conditions if there is a difference between such rules and policies. We will not be held liable for any losses that occurs or arise as a failure to comply with the rules and policies of the App Store from which you download the Detourdrive App.
   
   

You agree that the terms and conditions of this agreement shall apply to all updates and future version releases of the Detourdrive app which will be released at our discretion from time to time. You agree that the terms of this Agreement shall apply to all updates, upgrades or new releases provided to You whenever and wherever applicable.  It is your responsibility to ensure that your mobile device connects to the appropriate App Store provider in order to utilize the latest version available.

Neither Detourdrive, nor the TPPP nor the bank shall be liable for any security vulnerabilities resulting from you not using the latest available release, upgrades or updates when they are made available via the appropriate App Store.

FEES & BANK CHARGES

Transactions that you perform will incur a processing fee.  Such fees will be displayed within your Detourdrive App.

These fees may include bank fees, transaction fees, cash-out voucher fees, transfer fees etc.  By agreeing to the terms of this agreement you acknowledge that such fees may be deducted from your wallet balance and revised from time to time.

LOADING YOUR WALLET

Once you have requested a payroll advance and such payroll advance has been approved then this payroll advance will be deposited into your Detourdrive wallet. These funds will then be available for withdrawal.

PURCHASING OF THIRD-PARTY PRODUCTS AND VALUE-ADDED SERVICES

Your wallet balance can be used to purchase a variety of on-line products which are available on the Detourdrive App. When making a purchase you will be prompted to insert your mobile number or the mobile number you wish to send airtime, data or value-added services to. It is your responsibility to use the correct mobile number for the recipient. We will not be liable for any loss or non-delivery of airtime, data, prepaid electricity or product PINS should an incorrect number be used.  

PAYMENTS TO MERCHANTS WITHIN THE DETOUR NETWORK

Your wallet balance can be used to purchase goods and services from a merchant that is a participating merchant in the Detourdrive network.

CASH-OUT METHODS

You can.  Use the following cash-out methods when performing a cash-out from your wallet:

1. You can cash-out from your wallet to your own bank account that is registered as a beneficiary on your profile. It is your responsibility to ensure that the correct bank account details are stored for a beneficiary.  We shall not be liable for making payments into a bank account when the beneficiary details are deemed to be incorrect.
   
   

2. You can redeem your cash-out vouchers at Nedbank ATMs and at Nedbank Retail partners’ Money Market Counters or Kiosks.
   If you are redeeming your cash-out vouched at a Nedbank ATM you acknowledge that the Nedbank ATM may only dispense cash notes that are available inside the ATM at the time of cash-out.  Typically you must cash-out value in increments of R20.00.  Detourdrive
   and its TPPP shall be entitled to apply a fee for ATM and Retail cash-outs, such fees will be displayed within the Detourdrive App
   on your transaction history. If the Nedbank ATM does not have the prerequisite full value of notes then you can cash-out a portion
   of the funds as cash. If you find that a Nedbank ATM goes off-line as a cash-out transaction is being processed then Detourdrive
   will endeavour to execute a refund back into your wallet so that you can perform a cash-out at an alternate Nedbank ATM or at a
   retail partner.

• Kazang participating outlets
  
  

The retail partners may vary from time to time.

In the event that an incorrect mobile number is used when making a cash-out transaction and the cash-out voucher and PIN is sent to
an incorrect number inserted by the user then we shall not be held liable for any losses resulting from this action.

OPT-IN SERVICES

You may elect to opt in to services provided from time to time via the Detourdrive App. You may elect to opt-out of services at any time
by selecting the Opt-Out prompts within the App.

Privacy Policy

Any information collected by the Detour website and the Detour App/wallet system will only be used internally by Detour and its payment processing TPPP and the third-party providers such as drivers or merchants within the Detourdrive ecosystem. 

We will use your information to send you confirmation of your purchase(s) and any payments made to merchants when using your digital wallet to pay for goods and services within the Detour ecosystem.

Detour shall not rent, sell or otherwise disclose your personal information to any third party without your consent.

You may receive invitations to buy goods and services or other related products, but you may unsubscribe from these invitations at any time. Detour may from time to time send wallet subscribers a variety of SMS or WhatsApp messages which include transaction information, wallet balance information and sales receipts. Should the recipient block these messages then Detourdrive shall not be liable to re-send these messages. The messages are not marketing material but may be notifications, authentications or information messages that relate to the payments in question.

YOUR CONSENT

By visiting our website or Mobile App and/or registering as one of our subscribers, you consent to us collecting, storing, using and
(if applicable) transferring your personal information in accordance with this privacy promise.

If we decide to change our privacy promise, we will post those changes to our website.

THE INFORMATION WE COLLECT

In order to provide the best level of service, we will collect information using the following methods:

• Upon sign up, information is stored depending on the answers you provide.

• Information that you submit when you use the digital wallet to purchase, transfer or cash-out is also stored.

• User preferences are stored as and when you complete them.

• Information about your usage of the Site is collected.

• Information about your mobile device may be collected.
  
  

HOW WE USE THE INFORMATION

We may use your information in the following ways

• To ensure the content from our Site is presented in the most effective manner.

• To provide optimum customer service to you.

• To notify you of changes every now and again.

• To enable Detourdrive to provide appropriate products and services to you.

• For internal marketing and demographic studies in order to improve our service.

• For marketing communications from us. You can opt out of this by contacting Detourdrive or clicking the unsubscribe at the bottom
  of any email newsletter that may be sent to your mobile phone number or e-mail address provided to us.
  
  

THIRD PARTY SITES

The website or Mobile App may contain links to websites operated by third parties, namely our Suppliers. Detourdrive nor our TPPP
nor the bank accepts any liability or responsibility for those websites.

PROTECTING YOUR INFORMATION

All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted using SSL technology.

Where we have given you a password (or you have chosen one), you are responsible for keeping this password confidential.

Appropriate security measures are adopted to protect your information from access by unauthorised persons.

We strive to do our best to protect your personal data.

DISCLOSURE OF INFORMATION

We may disclose your personal information in the following circumstances:

• To our Suppliers in order to secure a product or service where disclosure is necessary to enable us to process your order
  and/or provide you with a service.

• Where required to do so by law or court order.

• Upon the sale of the business

• To any person to whom disclosure is necessary to enable us to enforce our rights under this privacy promise or under our Terms
  and Conditions.

Other that as expressly set out in this privacy promise or as otherwise required or permitted by law, we will not share, sell or distribute any of the information you provided us without your consent.

ACCESSING YOUR INFORMATION

You may at any time request access to your personal data by contacting Detourdrive. We reserve the right to ask you for proof of your identity and to charge you an administration fee.

DISCLAIMER AND LIABILITY

You understand and agree that the use of the Detourdrive Digital Wallet and associated Services is at your own risk. We as a collective do not make any representation or guarantee that the use of the App and Services will yield the results intended by you. We make no warranty that the service will be uninterrupted, timely or secure and/or error free. No advice or information obtained from Detourdrive, its employees, consultants, representatives and partners, whether oral or written shall be construed as a warranty.
 

INDEMNIFICATION

You agree to indemnify and hold harmless Detourdrive, its TPPP, their officers, directors, employees, suppliers, and affiliates, from and against any loss and costs arising out of or relating to any claims that you have used the Services in violation of another party's rights, in violation of any law, in violation of any provisions of this Agreement, or any other claim related to your use of the website or Mobile App.

NON-VARIATION

We reserve the right to modify and adjust the terms and conditions of this Agreement. We will strive to notify you of these changes prior to the effective date of the new terms. Should any provision in the terms and conditions become obsolete, the validity of the remaining provisions will not be affected.

APPLICABLE LAW

The relationship between the parties is governed in South Africa, any dispute or lawsuit arising out of or in connection with this Agreement will be exclusively dealt with by the laws governing South Africa.
